1. Parties
These General Terms govern the photography services provided by Valorem Management SL (the "photographer"), NIF B67581801, Ferran Agulló 22 ENT 2, 08021 Barcelona, Spain, trading as Photoshoots by Helmy, to the client ("you") who books a photography session.
2. Services offered
The photographer offers private photography sessions on the Costa Brava (Lloret de Mar, Tossa de Mar, Girona and surrounding areas), in the form of standard packages (currently "Essentials" and "Comprehensive") and tailor-made sessions. The current package contents, durations and prices are listed on the homepage and form part of these Terms.
3. Booking and confirmation
A booking is requested through the contact form on this website or directly via WhatsApp or email. The booking is only confirmed once the photographer has agreed a date and time in writing (email or WhatsApp message). Bookings are subject to availability and are not automatically accepted.
4. Prices and payment
Prices shown on the website are in euros (€) and, unless stated otherwise, include any applicable Spanish VAT. A deposit may be requested to confirm a booking; the remaining balance is due by the day of the shoot, unless otherwise agreed in writing. Accepted payment methods will be communicated at the time of booking.
5. Cancellation and weather
- Client cancellation more than 72 hours before the shoot: any deposit is refunded in full, minus unavoidable third-party fees already incurred.
- Client cancellation within 72 hours of the shoot: the deposit may be retained as compensation for the reserved time.
- Weather: if the weather makes the shoot unworkable at the agreed location, the photographer will propose a new date at no extra cost. If no suitable alternative is possible, the deposit is refunded.
- No-show: if the client does not appear at the agreed time and place and cannot be reached, the full session fee may be due.
- Photographer cancellation: in the unlikely event that the photographer must cancel, any amount paid will be refunded in full. The photographer's liability in that case is limited to that amount.
6. Delivery of photographs
Edited, high-resolution photographs are delivered through a private online gallery, normally within 48 hours of the shoot. The gallery remains accessible for a minimum of 30 days; the client is responsible for downloading the files within that period. Extra or earlier deliveries can be agreed against an additional fee.
7. Copyright and usage
The photographer retains copyright in all images in accordance with Article 5 of Spanish Copyright Law (Real Decreto Legislativo 1/1996). By booking a shoot, the client is granted a non-exclusive, worldwide, perpetual licence to use the delivered images for personal, non-commercial purposes (prints, gifts, sharing on private social media). Commercial use of the images requires a separate written agreement and may be subject to additional fees.
Unless the client opts out via the model-release form provided before or at the shoot, the photographer may use a selection of images for portfolio, website and social-media purposes. The client can withdraw this permission at any time in writing for future uses.
8. Liability
The photographer is liable only for direct damage caused by proven negligence, up to the amount paid by the client for the session. The photographer is not liable for unavoidable external factors (weather, public events, civil unrest, connection failures outside her control, etc.). Nothing in these Terms limits any non-waivable rights you may have under Spanish consumer protection law.
9. Client obligations
The client confirms that all persons participating in the shoot are aware of and agree to being photographed, and that the client has authority to give that confirmation (including for minors under their guardianship). The client is responsible for appropriate behaviour during the session and for the safety of their group in outdoor locations.
10. Applicable law and dispute resolution
These Terms are governed by Spanish law. Disputes will be submitted to the courts of Barcelona, without prejudice to any overriding consumer rights. Consumers resident in the European Union may also use the online dispute resolution platform provided by the European Commission at ec.europa.eu/consumers/odr.
11. Changes
The photographer may update these Terms from time to time. The version applicable to your booking is the version published on this site at the time your booking is confirmed.
